The Rise in Healthcare Fraud

Medicare/Medicaid Fraud has seen a sharp spike recently in terms of federal prosecutions.  With the ever-changing healthcare regulations, the implementation of the Affordable Care Act (ObamaCare), there is now an influx of federal cases being pursued across the country.  For instance, there is now, the Medicare Fraud Strike Force which operates in nine cities across the country, and which has now charged more than 1,700 defendants who have collectively billed the Medicare program for more than $5.5 billion. The task force investigates those individuals that are suspected of billing for home health care and therapy services that were medically unnecessary and/or not provided or falsifying medical documents and filing exaggerated claims.

These investigations are not only occurring St. Louis but all across the country. In particular two cases arising out of Miami, Florida, individuals were indicting for falsifying health care related documents when services or equipment was not provided. One individual plead guilty to one count of conspiracy to commit health care fraud for his role in the $63 million health care fraud scheme. This defendant could face up to 10 years in the Federal Bureau of Prisons. Two other individuals in Miami, pleaded guilty to one count of conspiring to receive health care kickbacks and were sentenced in relation to their participation in a $48 million home health Medicare fraud scheme. Both were sentenced to serve time in the Bureau of Prisons and ordered to pay approximately $3 million dollars in restitution. These are significant crimes that require attentive legal representation.
